General terms and conditions of sale

1. Payment Terms

A 50% deposit is required upon order confirmation.

The deposit may be paid by debit card, cheque, Interac e-Transfer, or credit card.

The remaining 50% balance is due upon receipt of the sauna and may be paid only by debit card, cheque, or Interac e-Transfer (credit cards are not accepted for the final balance).

Financing options are available upon request (certain conditions apply).

2. Manufacturing and Delivery Times

Our saunas are delivered within an estimated timeframe of 3 to 6 weeks from order confirmation, or at a later date agreed upon with the customer.

If the customer requests a postponement, the order will be rescheduled according to our availability at the time of the request. No revised delivery timeframe can be guaranteed unless otherwise agreed upon in advance with one of our sales representatives.

Delivery timelines are provided for informational purposes only. Additional delays may occur due to circumstances beyond our control, including but not limited to supply chain disruptions, weather conditions, force majeure events, or other unforeseen circumstances. Sauna Boréal shall not be held liable for any damages resulting from delivery delays.

3. Optional Services and Electrical Installation

The following services are available upon request and are billed separately unless otherwise specified in the signed quotation:

• Delivery: transportation and unloading at the location agreed upon with the customer.

• Installation: assembly and setup of the sauna by our team.

• Staining Service: application of a protective oil finish to exterior red cedar surfaces by our team. This service is optional and is not included in the product price.

Any service not expressly stated in the quotation shall be considered excluded from the sale price.

Electrical Installation

All electrical connections must be performed by a licensed electrician holding the appropriate RBQ certification and remain entirely the customer's responsibility.

Upon order confirmation, we may provide references to trusted electricians upon request.

4. Red Cedar Maintenance

To preserve the natural beauty of the wood and extend its lifespan, we recommend applying a protective oil finish to all exterior surfaces.

Light sanding may be performed before application, particularly if the sauna has been in your possession for some time or if the wood has begun to weather and turn grey. This step promotes better oil penetration and restores the natural appearance of the cedar.

These maintenance recommendations are not covered under warranty and remain the responsibility of the owner.

5. Retention of Ownership

All delivered products shall remain the exclusive property of Sauna Boréal until the invoice has been paid in full.

In the event of non-payment, Sauna Boréal reserves the right to repossess the goods without prejudice to any other remedies available under applicable law.

6. Refund and Cancellation Policy

Saunas (Custom-Built Products)

Refunds may be granted only if the order has not yet been delivered. The deposit paid at the time of ordering is non-refundable in all circumstances.

Once the order has been delivered, no refunds will be accepted. All delivered sales are considered final.

Sauna Heaters

Sauna heaters may be refunded only if the original packaging remains unopened and the product is returned in perfect condition, subject to the following conditions:

• If a deposit was paid at the time of ordering or in-store purchase, the deposit is non-refundable.

• If no deposit was paid, a restocking fee equal to 20% of the heater's purchase price will apply.

Any cancellation or modification request must be submitted in writing.

7. Claims and Visible Defects

Any claim relating to visible defects, non-conformity, or damage observed upon delivery must be reported in writing within eight (8) days of receipt and must include photographs and a detailed description.

After this period, no claim shall be accepted.

8. Warranty

Sauna Boréal saunas are covered by a one (1) year warranty against manufacturing defects from the date of delivery.

This warranty does not cover:

• Natural wear and aging of the wood, including darkening, minor cracking, or greying due to exposure to weather conditions;

• Damage resulting from misuse, negligence, or inadequate maintenance;

• Any modification made by the customer.

Sauna heaters and accessories distributed by Sauna Boréal (including Harvia products and other brands) are covered by their respective manufacturers' warranties.

9. Late Payment

Any outstanding balance not paid by its due date may be subject to interest charges at a rate of 1.5% per month (18% annually).

Sauna Boréal reserves the right to suspend any ongoing order without prior notice in the event of non-payment.

If a balance remains unpaid for more than sixty (60) days after its due date, the account may be transferred to a collection agency or become subject to legal proceedings.

All collection costs, legal fees, and related expenses shall be the responsibility of the customer.

10. Limitation of Liability

Sauna Boréal's liability shall be limited to the value of the order concerned.

Under no circumstances shall Sauna Boréal be liable for indirect damages, loss of business, loss of revenue, loss of profits, or any other consequential damages arising from the sale, delivery, installation, or use of its products.

11. Governing Law

These Terms and Conditions shall be governed exclusively by the laws of the Province of Quebec and the applicable federal laws of Canada.

Any dispute arising from or relating to these Terms and Conditions shall be submitted to the exclusive jurisdiction of the courts of the Judicial District of Longueuil, Quebec.
